These Terms are maintained by Bettor Design LLC, the company behind IceTunes. They describe the rules for using the IceTunes app for iPad and iPhone, the IceTunes web app, and the IceTunes website (together, the "Services").
Agreement to Terms
By accessing or using IceTunes, you accept and agree to be bound by these Terms. If you do not agree, please do not use the Services.
If you use the IceTunes app for iPad or iPhone, your use of the app is also subject to Apple's Standard Licensed Application End User License Agreement (the "Apple Standard EULA"): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms supplement the Apple Standard EULA with IceTunes-specific information. They do not replace it.
Description of Service
IceTunes is an audio platform for events on ice, such as hockey games, figure skating and curling. It helps you run the music, sound effects, and announcements at a game or event from an iPad, iPhone, or computer. The Services include:
- Cue sheets of songs trimmed to the moment, organized into events and tiles
- Boards and layouts for desktop, iPad, and phone
- Sample pads, player rosters, and generated player announcements
- Playback of songs through Apple Music, and of audio files you upload
- An audio desk with faders, fades, dim, the announcer mic, and talk-over
- Syncing across your devices, and a phone remote for the device on the PA
- AI suggestions for songs and name pronunciations
Free and Paid Plans
IceTunes is currently available free while in early access. We may introduce paid plans or limits later; any price, billing period, trial, or feature change will be shown to you before you buy. Offers made to the waiting list, such as a discount on the first season, apply on the terms stated when the offer is made.
User Accounts
Account Creation
- Sign in with Apple, Google, or an email and password to use IceTunes and sync across devices
- You are responsible for keeping your account, password, and devices secure
- You must be at least 13 years old to create an account
Account Responsibilities
- You are responsible for all activity that occurs through your account
- You must tell us promptly about any unauthorized use of your account
- We may suspend or terminate accounts that violate these Terms
Music Licensing and Public Performance
IceTunes is a tool for playing music you are entitled to play. It does not grant you any right to play music in public.
- Playing recorded music over speakers at a rink, arena, or other venue is a public performance. It usually requires licences from performing-rights organizations (such as ASCAP, BMI, SESAC, and GMR in the United States, SOCAN in Canada, or PRS/PPL in the United Kingdom), which are typically held by the venue, league, or organization.
- An Apple Music subscription is licensed by Apple for personal use under Apple's own terms. Whether it may be used for playback at a public event is governed by those terms, not by IceTunes.
- You are solely responsible for making sure that you, your team, and your venue hold every licence and permission needed for the music and audio you play through IceTunes.
Players, Rosters, and Announcements
Rosters let you add details about players, such as names, numbers, pronunciations, photos, and songs, and generate spoken announcements for them. Announcements are made by you, the family or team using IceTunes, not by us: IceTunes generates a clip only when you ask, on your instruction, from the words you provide. Before your first announcement or pronunciation suggestion, the app asks you to agree to the points below, and records that you did. When you add players or make announcements:
- You confirm that you are entitled to use each player's details and likeness for game-day announcements, for example on behalf of their team, club, or rink
- For players under 18, you confirm you have the permission of a parent or guardian as your organization requires
- For every player you generate an announcement or a pronunciation for, you confirm that you are their parent or guardian, or have their parent's or guardian's permission
- You understand that generating a pronunciation or an announcement sends the player's name, and the announcement line, to our providers (Anthropic and ElevenLabs), who may keep it and use it to improve their services, as described in our Privacy Policy
- You will remove a player's details when asked to by the player or their parent or guardian
- You are responsible for listening to generated announcements before you play them, and for the announcements you play
Acceptable Use
You agree not to use IceTunes to:
- Play, upload, or share audio you do not have the right to use
- Create content that is illegal, harmful, threatening, abusive, or offensive
- Generate announcements that mock, harass, or demean any person
- Violate any laws or regulations, or anyone's privacy or publicity rights
- Infringe on intellectual property rights
- Transmit spam, malware, or other harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Resell or commercially redistribute the Services without permission
Content Ownership and Rights
Your Content
- You retain ownership of the cue sheets, rosters, layouts, and other content you create in IceTunes, and of the files you upload
- By using IceTunes, you grant us a limited license to store, display, process, and transmit your content as needed to operate the Services (for example, to sync it across your devices or to generate an announcement you ask for)
- You are responsible for making sure your content does not violate anyone's rights
Our Content
- IceTunes, its branding, its built-in sounds, its cue sheet templates, and its original content are protected by copyright and other laws
- You may not copy, modify, or distribute our content without permission
- Songs, artwork, and previews from Apple Music belong to their owners and are provided by Apple; IceTunes does not own them
Audio and Images You Upload
Ownership and Rights
- You represent that you own, or have all necessary rights and licences to upload and publicly play, any audio file you add, and to use any image you add
- You are solely responsible for the content you upload and the consequences of uploading it
License Grant
- By uploading audio or images, you grant IceTunes a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit them solely as needed to provide the Services, including a reasonable period after deletion to remove them from backups
Prohibited Content
You must not upload audio or images that:
- You do not own or have permission to use
- Infringe any intellectual property right
- Contain obscene, pornographic, or sexually explicit material
- Contain hate speech, discriminatory content, or harassment
- Violate any applicable law or regulation
- Contain malicious code
Moderation and Removal
- We may, but have no obligation to, review, monitor, or remove content at our sole discretion, including content reported to us
- We may suspend or terminate accounts that repeatedly upload infringing or prohibited content
Apple Music
IceTunes plays songs from Apple Music. Full songs need your own active Apple Music subscription on the device; without one, songs play Apple's 30-second previews. Song availability, clean and explicit versions, and previews are decided by Apple and can change or vary by country. Your use of Apple Music is governed by Apple's terms.
Game-Day Use
IceTunes is designed for live games, and we work hard to keep it dependable, but it depends on your device, its settings, your internet connection, Bluetooth and speaker equipment, and services we do not control, such as Apple Music. Test your setup before each game (the Rink check helps) and keep a backup plan. We are not responsible for missed, late, or wrong cues, or for sound played at the wrong level, during an event.
The Phone Remote and Synced Devices
When your devices are synced to a cue sheet, a phone you have synced can see what the deck is playing and control it: play, pause, stop, next, and play or cue songs on the PA. Only sync devices you control, and keep your account and devices secure.
Sharing, Discover, and Reports
Your cue sheets are private to your account. Discover shows templates made by IceTunes, which you may copy and adapt for your own games. If you see something that breaks these Terms, you can report it, and we may review and act on reports at our discretion.
Waiting List and Website Communications
If you join the waiting list, you agree that we may send you emails about IceTunes, its launch, and waiting-list offers. You can unsubscribe at any time using the link in those emails or by contacting hello@icetunes.com.
Definitions and Scope
"Services" means the IceTunes app for iPad and iPhone, the IceTunes web app, the IceTunes website, and the related features we provide. "User Content" means content you submit or create within the Services, including cue sheets, rosters, player details, layouts, audio files, and images. "You" and "your" means the person using the Services.
Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services, and have the legal authority to agree to these Terms. If you use IceTunes on behalf of a team, club, rink, or other organization, you confirm you are authorized to agree to these Terms for it.
Third-Party Services
IceTunes works with third-party services, including:
- Apple: Apple Music, Sign in with Apple, and the App Store
- Google: Google sign-in and the fonts on our website
- Supabase: accounts, storage, and sync
- Cloudflare: hosting
- Anthropic: song and pronunciation suggestions
- ElevenLabs: generated announcements
- Resend: the waiting list and its emails
Your use of those services is governed by their own terms. We are not responsible for third-party services and disclaim all liability related to them. See our Privacy Policy for how data is handled.
Apple App Store and iOS-Specific Terms
The IceTunes app for iPad and iPhone (the "App") is licensed, not sold, to you under the Apple Standard EULA: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If there is any conflict between these Terms and the Apple Standard EULA regarding use of the App, the Apple Standard EULA controls for the App license. You acknowledge that:
- Two-party agreement: These Terms are between you and Bettor Design LLC, not Apple. Apple is not responsible for the App or its content.
- Scope of license: You may use the App on Apple devices that you own or control, as permitted by the Apple Media Services Terms (including Family Sharing or volume purchasing).
- Maintenance and support: Bettor Design LLC is solely responsible for any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
- Warranty: Bettor Design LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation for the App.
- Product claims: Bettor Design LLC, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, and consumer protection claims.
- Intellectual property claims: If a third party claims that the App or your use of it infringes their intellectual property rights, Bettor Design LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance: You represent that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- Device requirements: The App requires a compatible iPad or iPhone and a supported version of iPadOS or iOS. We may end support for older devices or OS versions over time.
AI Features
IceTunes uses AI to suggest songs for your cue sheets, suggest how names are pronounced, and generate spoken announcements.
- AI output may be inaccurate, incomplete, or unsuitable. It is produced automatically by third-party models, and is not a statement or recommendation of Bettor Design LLC
- Check suggested songs before you play them, including that they suit your audience; the clean-songs-only setting relies on Apple's labels and is not guaranteed
- Check pronunciations and listen to announcements before you play them to a crowd
- AI features may have usage limits
Privacy and Data
Your privacy matters. Please review our Privacy Policy to learn how we collect and use information, including the player details you add. You can request deletion of your account and data at any time.
Data Retention
IceTunes keeps your cue sheets, rosters, and uploaded files for as long as your account is active. You can delete them yourself, delete your whole account in the app (Account, then Delete account), or ask us to delete your account and all associated data by emailing hello@icetunes.com; once verified, it is permanently removed within 30 days. Once data is deleted, it cannot be restored. Records of AI requests keep personal details for 90 days, as described in our Privacy Policy.
Service Availability
- We aim to keep IceTunes available, but cannot guarantee uninterrupted service
- We may perform maintenance that temporarily affects availability
- We may modify or discontinue features at any time
- We are not liable for downtime or interruptions
DMCA Policy
IceTunes respects the intellectual property rights of others. If you believe content on IceTunes infringes your copyright, you may send a DMCA takedown notice to hello@icetunes.com with:
- A description of the copyrighted work you claim has been infringed
- A description of where the infringing material is located
- Your contact information (name, address, phone, email)
- A statement that you have a good faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act for them
- Your physical or electronic signature
If you believe your content was removed in error, you may send a counter-notification. We will terminate the accounts of repeat infringers in appropriate circumstances.
Termination
By You
- You may stop using IceTunes at any time
- You may delete your account in the app (Account, then Delete account), or ask us to by emailing hello@icetunes.com
By Us
- We may suspend or terminate your account for violations of these Terms
- We may discontinue the Services with reasonable notice
- Upon termination, your right to use the Services ends immediately
Disclaimers and Limitations
Service Disclaimer
- IceTunes is provided "as is" without warranties of any kind
- We do not guarantee that the Services will meet your specific needs
Limitation of Liability
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the Services in the 12 months before the claim
- Some jurisdictions do not allow these limitations, so they may not apply to you
AI Disclaimer
- You assume all risk from using or relying on AI output, and are solely responsible for what you play
- To the maximum extent permitted by law, Bettor Design LLC is not liable for any loss, damage, or injury arising from AI suggestions or generated announcements
Indemnification
You agree to indemnify and hold Bettor Design LLC and IceTunes harmless from any claims, damages, or expenses arising from your use of the Services or violation of these Terms, including claims arising from the music and audio you play or upload, from the player details you add, and from announcements you generate and play.
Export Controls and Sanctions
You may not use the Services if doing so violates applicable export control or sanctions laws.
General
These Terms are the entire agreement between you and IceTunes regarding the Services and supersede prior agreements. If any provision is found unenforceable, the remaining provisions stay in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We are not liable for delays or failures due to events beyond our reasonable control.
Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Massachusetts.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after changes means you accept the new Terms.
